Constitutional Litigation
The Constitution of Kenya, which was adopted by Kenyans on 27th August 2010, provides a wider range of human rights protections as compared to the Repealed 1963 Constitution. The New Constitution introduced new classifications of rights such as Socio-economic rights. It also provides for rights protection for specific groups of people such as children, the disabled, the youth, women and older members of society.
The New Constitution also provided for an elaborate system to address human rights violations. In addition to individuals commencing constitutional petitions or judicial review applications on their own behalf, the Constitution now allows a person(s) to institute court proceedings on behalf of, a group or class of persons; or in the public interest.
We act for and defend our clients’ fundamental rights and freedoms and fundamental breach of the constitution. We have acted to protect our Client’s constitutional rights through class actions as well as public interest litigation. Notably, we have commenced suits to protect the larger public’s socio-economic rights and to seek remedial action for violation of the rights of specific groups within specific geographical locations and/or social stratum. We have also successfully defended various institutions against allegations of violations of human rights.
